Ferrari fights on

Despite a federal ruling allowing companies to modify and import to the U.S. so-called gray market non-U.S.-specification 2001 Ferrari 360 Modenas and 550 Maranellos (AW, April 22), Ferrari is renewing its challenge with 2002 models.

In a memorandum filed with the Department of Transportation Oct. 18, attorneys for Ferrari North America allege that California importer G&K Automotive Conversions Inc.'s request to import 2002 360 Modenas should be denied. Ferrari questions a number of proposed modifications as insufficient to permit non-U.S.-market 360s to meet U.S. safety standards. Ferrari also argues that U.S. and non-U.S. cars are not ``substantially similar,'' a claim DOT rejected in April.
