2001 NOV 14 - (NewsRx.com & NewsRx.net) -- PowderJect Pharmaceuticals Plc (PJP), a specialty vaccines company, and its wholly owned subsidiary PowderJect Vaccines, Inc., have successfully challenged Vical Inc.'s (VICL) core European patent relating to naked DNA vaccines. As a result of this challenge, mounted by PowderJect and six other parties, the European Patent Office overturned Vical's patent in its entirety, determining that the company's European Patent No. 0 465 529 contained no allowable claims.
PowderJect already holds extensive granted European and U.S. patents covering powder injection of DNA vaccines, giving the company exclusive coverage of this unique immunization technology. Importantly, the opposition process to the Vical patent confirmed that Vical does not claim any ownership of DNA vaccination via powder injection.
"We felt it important to oppose Vical's patent and we are therefore extremely pleased with the ruling," said Charles Swingland, general counsel of PowderJect. "This important case confirms the strength of our ownership of DNA vaccination by powder injection while making the proprietary position relating to liquid delivery uncertain. Following this success in Europe, we are continuing our efforts to expand our robust intellectual property position in the U.S."
