In Washington State last fall, AIDS patients and their kin filed a complaint with the Office of Civil Rights, U.S. Department of Health and Human Services (HHS) . They contended that 42 nursing homes, about half the total in King County (Seattle, etc.), barred AIDS patients.
A consumers' guidebook prepared by the county ombudsman's office listed facilities according to their features and policies. AIDS patients were not listed among types of patients that each targeted facility would take. The mother of one claimed to have called around to confirm that. She then filed her complaint. The Office of Civil Rights (OCR) was required to investigate. Nursing homes complained about the OCR's onerous request for an unwarranted amount of information.
It was not true that the homes excluded AIDS victims. Nevertheless, as of late March, all nursing homes have signed, or are in the process of signing, voluntary consent agreements to avoid being sued. Those took the form of letters of understanding in which most nursing homes insisted that ...
