M and I Mortgage sues to protect Internet service.

M&I Mortgage Corp. has filed a lawsuit to defend its Internet mortgage division, mortgagebot.com.

The Cedarburg subsidiary of Marshall & Ilsley Corp., a Milwaukee bank holding company, claims that mortgage.com, a Florida-based Internet mortgage company, violated its trademark by developing a Web site to offer mortgage loans.

The lawsuit, filed in U.S. District Court in Milwaukee, accuses mortgage.corn of confusing consumers by developing a visually similar Internet site.

M&I Mortgage is asking for damages in excess of $100,000, according to the complaint.

Officials at mortgage.corn did not return calls for comment on the lawsuit.
