Patent suits' success rate significantly higher
The success rate of patent lawsuits is steadily improving and their significance will increase further due to more high-tech footwear, pending legislation and the formation of a specific appeals court, patent attorneys said.
Daniel Gropper, a Washington D.C. patent attorney, said he envisioned more and more patent suits will soon be filed. "This is just the beginning,' he said. "That patent system is finally straightening out.'
Gropper noted courts had a tendency a few years ago to consider patents and trademarks synonomous with monopolies. "Now better than 60 percent of the suits are being upheld by the courts.'
