The second set of frequently asked questions (FAQs) on 42 CFR Part 2 is out, and it gives some helpful guidance as providers continue to try to select electronic health records (EHRs) that will be compliant with the regulation governing confidentiality of alcohol and drug abuse patient records.

Although it is not a legal document, it gives the opinion of the Substance Abuse and Mental Health Services Administration (SAMHSA), which implements 42 CFR Part 2. It says, for example, that unless the provider is specifically holding itself out to be a substance abuse treatment provider, compliance isn't necessary.
