A Mombasa judge on Monday struck out a case against the inclusion of Kadhi courts in the Proposed Constitution.
Justice Mohammed Ibrahim ruled that the High Court had no jurisdiction over matters affecting the constitutional review process. The case had been brought by Bishop Joseph Kimani, the Reverend Musyoka Nzui and Ms Agnes Mbinya, who wanted certain sections of the review law nullified, including one dealing with the Kadhi's courts.
