ARE HOSPITAL BASED PHYSICIANS PROTECTED BY GOOD SAMARITAN ACTS WHEN RESPONDING TO CODES? The answer to that question will usually depend upon the facts of the particular case. However, in this interesting Utah case, the Court focused upon whether or not a physician who responded to a code was required to do so. The case, held that the "requirement to respond" is key to the issue of whether or not a physician may be entitled to the protection of the Good Samaritan Act.
