THE case for confirming Judge Sonia Sotomayor to the Supreme Court is nearly as damning as the case against her. Listen to her defenders. They say that she would be the first Latina justice, and that Republicans should therefore tremble before voting against her. They point to no flashes of brilliance in her legal opinions, presumably because there are none. They do not claim that she has distinguished herself by her fidelity to the law, presumably because neither she nor they think in these terms.
Identity politics has not proven an unalloyed boon for this nomination. The White House had to do damage control following a controversy over Sotomayor's claim, made in a speech and a law-review article, that the richness of Hispanic women's experiences could help them make better decisions than white male judges would. Her language was imprecise--for example, she described impartiality as an "aspiration" before questioning whether it was either possible or desirable--yet her meaning was clear.
