Competition law transformed New era for enforcement Introducing criminal liability for directors would have far-reaching effects on SA's justice system, writes THE Competition Amendment Bill has not been passed into law yet due to concerns about the constitutionality of certain provisions. The amendments include provisions that deal with directors or certain managers who cause (or acquiesce to) a firm engaging in cartel conduct and are guilty of a criminal offence. However, the competition authorities will not have the jurisdiction to deal with the criminal offences contained in the bill. Instead these offences will be prosecuted in the criminal courts. …
