Team Penske's Jan. 13 news conference at which it was announced that Will Power potentially could replace Helio Castroneves sparked more questions than answers, as it is too early to know what lies ahead for the No. 3 car. Castroneves is in a legal mess, facing seven federal charges ranging from tax evasion to defrauding the U.S. government. If convicted on all counts, he faces up to 35 years in prison.
Castroneves, who pleaded not guilty and insisted on his innocence, is certain to contend that he did not know what was happening to the $5.5 million in wages that allegedly went through offshore shell corporations to avoid taxation. But his defense must tiptoe down a path that could inadvertently lay the blame on his business managerand sisterKati.
The trial in U.S. District Court in Miami is scheduled to begin March 2, though legal buffs predict that the heat will increase a couple of weeks before that. A trial-avoiding compromise would not be shocking, but a plea probably would lead to the termination of Castroneves's contract.
If Castroneves stands trial, he needs to win and win quickly. Penske Racing president Tim Cindric said a return to the car in 2009 will be guaranteed only if the Brazilian is exonerated before the season-opening race in St. Petersburg, Fla., on April 5, barely a month after the trial is set to begin.
