THE MCPS-PRS ALLIANCE is kicking off what is expected to be a raft of appeals by European collecting societies against the EC's recent decision to shake up the sector.
In a move that is expected to cost millions, the Alliance is likely to be one of the first societies to bring an appeal against the mid-July antitrust decision, which made key objections to how societies operate.
The July 16 ruling effectively outlawed the international agreements allowing cross-border collection of royalties and focused on three key areas:
* membership restrictions that prevent authors from choosing which society can represent them
* the territorial exclusivity clause preventing collecting societies from offering licences to users outside their territory
* concerted practice, where all societies are alleged to have the same territorial restrictions.
Some societies, including the Alliance and umbrella organisation Cisac, claim membership and exclusivity have already been dealt with.
