JVC Labs, the software developer working on retouching software that Quark was supposed to market as Xposure, filed in July a multimillion-dollar suit against Quark, saying that Quark has breached its contract and given up on the product.

JVC is demanding that an arbitrator be appointed to settle the case. It alleges that Quark failed to address technical issues in good faith, failed to provide agreed-upon technical input concerning certain aspects of the software, misrepresented its true intentions concerning the development and commercialization of the Xposure product, and expressly refused to abide by the unambiguous terms of the agreement between the two firms. …
