In his introductory essay, Tushnet concedes that "perhaps the most we can hope" about a book treating the Warren Court at this time is that it be "a scorecard toting up decisions the analyst likes and dislikes" (1). Tushnet's hope, however, is that his book may serve as "a speculative beginning at a historical analysis of the Warren Court" (1). The book falls somewhere between his concession and his hope.
