Last year, Judge Laurence Silberman threw out the D.C. handgun ban as a violation of the Second Amendment. The Supreme Court has now taken up the case, and the Bush administration has, surprisingly, weighed in against Judge Silberman. Solicitor general Paul Clement agrees with Silberman that the amendment protects an individual right to own guns but allows reasonable restrictions on that right. Clement says that the District's ban may violate the amendment. But he argues that the judge applied too strict a test to determine which regulations are permissible, and worries that this test will make it impossible to sustain even laws against machine guns. ...
