In 2002, the CIA made a serious error in tape-recording early interrogations of two notorious terrorists. The men were subjected to tough tactics, probably including waterboarding. Fearing that the tapes might be leaked, in 2005 the head of the CIA's operations directorate ordered them destroyed. Now that act has prompted a criminal probe to determine whether justice was obstructed. This seems highly unlikely. The treatment of detainees at Guantanamo Bay has become an issue in court, but the treatment of high-level terrorists in secret CIA custody has not.
