Attorneys for a pair of real estate developers suing Fred Meyer over a deal gone sour alleged during a Sept. 27 hearing in Sacramento that Fred Meyer destroyed evidence.

The court will make a ruling on the allegations at a hearing scheduled for Oct. 12 in Sacramento County Superior Court. If the plaintiffs can convince the court that Fred Meyer destroyed evidence relevant to the case, they could move for a summary judgment. The plaintiffs, Tony and Barbara Musolino, allege Fred Meyer engaged in a coverup to conceal its real reasons for canceling its expansion into Northern California.
