The courts are again considering whether our treatment of detainees should follow the standards of war, or of ordinary criminal cases. In the latest decision, the D.C. Circuit Court of Appeals found that Congress had stripped suspected-terrorist detainees of the right to challenge their detention in federal court, and that Congress acted constitutionally when it did that. That is the correct decision on both legal and policy grounds.
