A businessman is smiling all the way to a bank after he obtained court orders for the release of Sh2.3 million the financial institution had withdrawn from his account.

Barclays Bank had transferred the money to another account, ostensibly to offset loans advanced to a company in which businessman Nicholas Mahihu Muriithi had an interest.

But Mr Justice Hatari Waweru found that Mr Muriithi had proved his case in demanding the money back.

He said it was improper for the bank to remove money from Mr Muriithi's account to repay loans that were likely to be declared time barred. …
