State appealing primary ruling: Judge decided that Va. Republicans may have closed primaries.

Dec. 30--The state has appealed a district court judge's decision that allows Virginia Republicans to close their political primaries.

The attorney general's office, on behalf of the State Board of Elections, also filed a motion to stay Judge Henry E. Hudson's order, pending the outcome of the appeal.

The attorney general's office said the question ultimately may be decided by the U.S. Supreme Court.

State Sen. Ken Cuccinelli, R-Fairfax, who brought the suit, filed a brief in opposition to the motion for a stay.

A stay could delay the effect of the ruling well past the June 13 primary date.
