Kate O'Beirne's "Strangle Holds" (August 29) quotes an unnamed "frustrated administration official" as saying, "For the Senate to conduct business as usual with the nation at war ... is so outrageous. They do not see the nation at war; that's a real difference between this president and Congress."
The reasons I placed a hold on Alice Fisher's nomination to be head of the Department of Justice's criminal division have everything to do with making sure that the executive branch does not go on conducting business as usual. Like it or not, the sad truth is that when letters from senators get ignored or dismissed, a hold is sometimes the only effective way to get the executive branch to focus on important issues. In this case the important issue impacted directly on terrorism-related activity on U.S. soil. Mrs. O'Beirne did not bother to explain the reasons for my hold, nor did she call or write to me for an explanation.
The Department of Justice was systematically blocking Congress's ability to gather information on a number of FBI oversight issues, including a case where the Bureau delayed for four months a wiretap request on an individual who was communicating with a designated terrorist.
