A legal challenge to the UK's working time practices that could have widespread ramifications for UK-based companies moved to the European Court of Justice last week.

The court is set to review the category of employee that can be considered to be outside the working time regulations.

At issue is whether the UK's derogation for partly unmeasured working time in regulation 20(2) goes beyond that permitted under the directive.

Also to be considered is whether UK provisions for daily or weekly rest breaks inadequately implement the directive.
