BRUSSELS attempted to capitalise on the chemical tanker collision in the Channel yesterday by linking it to European Commission plans for a new liability regime.
Proposals turning international conventions, in particular the Limitation of Liability for Maritime Claims Convention, into European Union law must be implemented urgently, Transport Commissioner Jacques Barrot said.
'I call on member states to start the discussion on the commission's proposal to improve liability and compensation payments in the maritime sector. Last night's collision shows the risk of maritime pollution.
'We must make sure those who cause damage are liable in the event of grave negligence and are obliged to pay compensations.'
The proposals, contained in the Erika 3 package of maritime legislation, have not yet reached the member state working groups and therefore are not expected to be discussed until the second half of this year at the earliest.
One of the directives would introduce unlimited liability for ships from third countries which have not ratified international liability ...
