DEFENSE SECRETARY AVELINO CRUZ JR. is playing down his role in crafting the controversial gag order that legal experts and lawmakers have denounced as unconstitutional.
According to a statement issued yesterday by the Department of National Defense, Cruz was consulted but did not prepare the draft of Executive Order No. 464, which bars Cabinet officials, military officers and government executives from testifying at congressional inquiries without President Macapagal-Arroyos approval.
Press Secretary Ignacio Bunye said on Thursday that Cruz played an active role in drafting the EO along with Presidential Chief Legal Counsel Merceditas Gutierrez and Justice Secretary Raul Gonzalez.
The press secretary named those behind the EO in the course of daring its critics to challenge its legality.
Even Ms Arroyos staunch allies in Congress are against EO 464.
