SARASOTA -- Joseph P. Smith's public defender is trying to stop prosecutors from using a car wash surveillance videotape that captured the abduction of 11-year-old Carlie Brucia.
The videotape replayed on televisions across the country in February 2004, and two dozen tipsters called to give investigators Smith's name as the man dressed in a mechanic's uniform who grabbed Carlie by the elbow.
A motion filed Monday by public defender Adam Tebrugge asked a judge for a hearing to make prosecutors authenticate the videotape before the trial, scheduled for Nov. 7.
