A pregnant woman injured in an automobile accident could not recover emotional distress damages for a potential injury to her unborn child, the Rhode Island Supreme Court has ruled.
The plaintiff was six-months pregnant when she was injured in a car crash. She hit her chin above where the airbag deployed, her head on the windshield and her knee against the dashboard.
She was taken to the hospital and examined. Emergency personnel also conducted an ultrasound and checked the fetal heartbeat, assuring her that everything was fine with the baby.
