Reaction to the U.S. Department of Education's "Additional Clarification for Title IX" was swift and strong.
As reported in WIHE last month, the March 17 "clarification" allows schools to determine student interest in a sport by using an Internet-based survey. Students who do not return the survey would be counted as uninterested in athletics participation, according to the department.
The NCAA's Executive Committee adopted a resolution in April that urged the department to rescind its changes and also encouraged NCAA member schools not to use procedures suggested in the clarification.
NCAA President Myles Brand said he would discourage reliance on the methods suggested by the Education Department "In my experience, college and university presidents and chancellors almost uniformly favor a strong Title IX," he said, but this clarification weakens it.
