The move was designed to protect majority leader Tom DeLay, who is being pursued by Democratic prosecutor Ronnie Earle. The Democrat has a history of flimsy political prosecutions: In 1993, he indicted Republican Kay Bailey Hutchison, who was up for reelection the next year, but never got around to presenting a case.
