For more than a year, conservatives, Republicans, and advocates of simple justice have wondered whether President Bush would use his power to make recess appointments to fill seats on the federal judiciary that are currently the targets of Democratic filibusters. Now he has. On January 16, the president appointed Charles Pickering to the appeals court for which he was originally nominated on May 25, 2001.
