May 26--The U.S. Department of Agriculture overstepped its bounds last year by trying to shut down a Dallas packing plant where meat tested positive for salmonella several times, a federal judge ruled Thursday.
U.S. District Judge A. Joe Fish's decision in the case involving Supreme Beef Processors Inc. essentially removes from federal regulators a powerful enforcement tool devised in 1996 to combat bacterial contamination in the nation's meatpacking industry.
Attorneys for the government would not say whether they intend to appeal the ruling, but Agriculture Secretary Dan Glickman vowed a fight to overturn "this wrong decision."…
