West Virginia Legislature May Overturn State Supreme Court Ruling on Insurance.

Feb. 26--A bill recommended Monday night by a House select committee would reverse a two-year-old state Supreme Court ruling that held exclusions in auto insurance policies were void without a reduction in rates for less coverage.

The ruling, known as Mitchell v. Broadnax, dealt with uninsured and underinsured coverage.

Two class-action lawsuits seeking refunds are pending against State Farm and Nationwide Insurance as a result of the ruling.

"Cases pending in court now would be extinguished" by the House bill, staff attorney Nancy Tyler said in response to a question from a committee member.
