Aug. 5--The electronic transactions law is unclear and will create problems for judges when legal cases arise, according to a seminar at the Court of Appeal last Friday.
Law professor Kanung Luechai said one of the problems was how to judge when a contract occurred.
Under civil law, a contract was regarded as binding when a proposal reached a receiver and there was a formal acknowledgement, but the electronic transactions law did not explicitly stipulate when a contract would be deemed to have reached the receiver, said Mr Kanung, who also chairs the drafting committee on law of electronic signature.
