2004 JUL 1 - (NewsRx.com & NewsRx.net) -- An Arizona woman who had both breasts removed and reconstructed because of cancer is not entitled to another reconstruction though her new breasts are not perfectly symmetrical, a state court ruled June 8, 2004.
A three-judge Court of Appeals panel upheld a trial judge's ruling in favor of the Arizona Health Care Cost Containment System and Mercy Healthcare Group, an AHCCCS-administered private employer group health plan.
The woman, whom the court identified only by her initials to protect her privacy, had a second reconstruction after the first one failed.
She sought a third reconstruction on grounds that the second one left her left breast flatter and smaller than the right one.
The physician who performed the first and second reconstructions said the second left the woman with breasts that were "fairly symmetrical" and only a "maybe about half a centimeter difference between the two sides."
