At around 3 a.m. on November 12, 2003, Jason Pena of San Antonio, Texas, was awakened by the alarm in his pickup truck. Grabbing a handgun, he ran from his home and confronted two men who had pried open a door of the vehicle with a screwdriver. Pena ordered them not to move, but they turned and ran. One jumped into a waiting car driven by a third accomplice, and the two drove off before the second culprit could hop in.

Pena fired several shots at the fleeing car but was not sure if any struck ...
