Homicide suspect Michael O'Learywon't return to La Cueva, but he's free;Ronnie Garcia, however, is not, and prosecutors hint at a prejudice in rulings.

Bernalillo County District Attorney Jeff Romero has challenged a ruling by a Children's Court special master that allowed second-degree homicide suspect Michael O'Leary out on $10,000 bail.

Romero also suggested special master Susan Alkema was biased in two rulings issued Tuesday, comparing the O'Leary decision with one she made the same day in the unrelated case of Ronnie Garcia.

Romero said late Wednesday that his office feels the circumstances of the O'Leary case call for stricter conditions of release, including a $50,000 cash-only bond.
