Late last night, news of a lawsuit filed against apparel retailer Abercrombie & Fitch broke across financial newswires. The lawsuit, which has been filed by a group of former and prospective employees of Asian and Latino descent alleges the retailer's use of discriminatory policy against those of varying race, color, or national origin. The company responded by saying it prides itself on diversity and takes these allegations very seriously. ANF officials had not yet been privy to the formal lawsuit documents as of last night's reporting. As far as ANF shares are concerned, they have recently slipped beneath their 10-day and 20-day moving averages. The stock is approaching the 26 region, which has contained a number of pullbacks so far this year. Technical analysis has proven, however, that as an area is tested more frequently, it becomes increasingly more likely that this region will fail in its support. Pessimism ranks high on the shares, as Schaeffer's put/call open interest ratio (SOIR) for the stock stands at 1.47, in the 94th percentile of all annual readings. This sentiment indicator reached an annual high on June 6.

America West Holdings

With 145 aircraft and 65 North American destinations, America West Holdings is one of the nation's top-10 airlines. Today, the stock enjoyed a brokerage upgrade from Merrill Lynch, who increased its rating on the stock to a "buy" from a "neutral." Since late March, around the time that the war with Iraq was petering out, the stock has benefited from a solid uptrend. Today's upgrade has boosted the shares 15 percent higher to a new annual high on heavy volume. Given the stock's low-priced status, options players have not yet taken a liking to the shares.
